(1) Introduction

This Privacy Policy ( “this Policy”) sets out how Emperor Watch & Jewellery Limited and its holding companies, subsidiaries, affiliates and associated companies  (collectively, “Emperor Group”, “we”, “our” or “us”) collect, use and handle your personal data provided to us, or which we have obtained from your visits to or use of our websites, mobile applications, social media platforms or our online services (collectively “our Platforms”) or purchase or use of any products, services, facilities (including loyalty or membership program and functions of our Platforms), offers and/or other subjects of any member(s) of Emperor Group (collectively “our Services”). 

You shall read this Policy carefully before provision of your personal data or placing order for or using our Services or visiting our Platforms. 

By using our Services, providing your personal data or accessing, browsing, using, subscribing or logging in on our Platforms, you acknowledge that you have read this Policy and accept the terms herein contained.

(2) Scope

We are dedicated to protecting your personal data and privacy in accordance with the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong SAR) (the “Ordinance”) and all applicable laws and regulations. 

(3) Purposes of collection and use of personal data

3.1 We will only use your personal data for the specific purposes mentioned to you on or before collection and purposes directly related to such specific purposes and such new purposes with your prior consent.  In general, but without limitation, we may use your personal data for the following common purposes or uses:

• (a) to provide you with our Services;
• (b) to process and follow up your orders, payments, enquiries, complaints and/or other requests (including to verify your identity and payment details);
• (c) to carry out and facilitate activities which you are enrolled in (e.g. loyalty or membership program, VIP sales or events)
• (d) to perform customer survey, research and statistical analysis for improving our Services, our Platforms and marketing;
• (e) to send you direct marketing materials if you have consented to it;
• (f) to comply with applicable laws, regulations and requirements of competent authorities;
• (g) to communicate with you; and
• (h) such other purposes mentioned at the time of collection and/or specified in the applicable Personal Information Collection Statement (“PICS”) which is provided to you on or before collection of your personal data.

3.2 If we wish to use your personal data for any new purposes, we will seek your prior consent before use.

3.3 Our Platforms are not intended for minors and we do not knowingly collect any personal data from minors, except as part of dealings to provide minors with our Services, in such event, a parental/guardian’s consent may be required before submission of personal data under the applicable laws and regulations. “Minors” shall be defined in accordance with the law applicable in the minor’s jurisdiction of residence (e.g. under the relevant privacy laws of PRC, a minor is a person under the age of 14, whereas under the Interpretation and General Clauses Ordinance (Chapter 1 of the Laws of Hong Kong SAR), a minor is a person under the age of 18). 

(4) Collection of Personal Data

4.1 When you interact with us, whether by using our Platforms, purchase or use of our Services or communicating with us, we may collect your personal data for the specific purposes as mentioned to you or specified in the PICS provided to you at the time of or before our collection of your personal data.

4.2 We will not collect, process or use your sensitive personal data unless with your prior consent or otherwise permitted or required by applicable laws and regulations, or for legitimate and necessary business purposes in accordance with the applicable law. Sensitive personal data includes one’s religious beliefs, specific identities, health, financial account and race.

4.3 The provision of your personal data (including sensitive personal data) is voluntary and we will not collect or process your personal data (including sensitive personal information) without your consent unless permitted by applicable laws.  However, if you do not consent to provide your personal data, we may not be able to provide our Services as requested by you or fulfill your request in full or respond to your enquiries.

4.4 You should read the applicable PICS provided to you together with this Policy before provision of your personal data.

(5) Retention of Personal Data

5.1 We will take all reasonably practicable steps to ensure that your personal data is not kept for a period longer than necessary for the fulfillment of the purposes for which we collected it, or for compliance with any legal, regulatory or reporting obligations or for assertion or defending against legal claims. 

(6) Cookies

6.1 Cookies are small text files that can be stored on a user’s computer, tablet or mobile device (“your Device”) when you visit a website. A cookie will typically contain the name of the originating domain, the lifetime of the cookie, and a randomly generated unique number or other value. The cookie itself is anonymous and does not contain any personal data, except when such data is supplied by you, for instance, when you provide your name and email address when completing a registration form.

(7) Disclosure and Transfer of Personal Data

7.1 We may disclose or transfer your personal data to the following third parties (whether locally or overseas):

• (a) service provider(s) or contractors engaged by us who provide administrative, data processing, data storage, collection of payment, IT supports, telecommunications, professional or other similar services to us;
• (b) any member of the Emperor Group, business partners that we partner with in connection with our Services or activities which you are enrolled in, our related companies, and other third parties to whom the disclosure or transfer of your personal data is to fulfill or facilitate the fulfillment of the purpose(s) for which your personal data is collected;
• (c) those third parties as set out in the relevant PICS; and
• (d) competent court, governmental bodies or authorities (such as regulatory bodies, law enforcement bodies, government and tax authorities, etc.).

(8) Direct marketing

8.1 We intend to use your name, birth month, mobile phone number, email address, correspondence address or such other personal data which you agree from time to time (whether provided by you or third party) for direct marketing purposes, including for sending/ showing you news, offers, events and activities in connection with Emperor Services (hereinafter defined) and to share your personal data with third party service providers (e.g. marketing agencies) or co-branding/ business partners and/or suppliers of Emperor Services for marketing and promotion of Emperor Services.  We may not so use or share your personal data without your written consent.

8.2 “Emperor Services” means products and services provided by us and/or members of Emperor Group, whether collaboration with co-branding/ business partners or not, such as watch, jewellery and other luxurious goods, information services (such as weather, finance and news information), device accessories, mobile applications and software, lifestyle, networking events, travelling, alcohol and tobacco, sports, music, gaming, transportation, automobile, household products, food and beverages, hotel (including serviced apartments), banking, finance, loan, insurance, wealth management services, investments, education, health and wellness, pharmaceutical, art and culture, environmental protection, charity, books and magazine subscriptions, publication and printing, beauty and cosmetics products and services, entertainment (such as movies, concerts and fans club activities), cinemas, fashion and accessories, computers and electronics, social networking, mobile payment, cloud services, technology, e-commerce, logistics, retail, real estates and shopping malls, home and decor, media, high-end consumer products and services, and such other goods and services provided by members of the Emperor Group from time to time.

8.3 If you do not wish us to use or provide to other parties your personal data for use of direct marketing, you may, at any time and without charge, exercise your opt-out right by writing to Customer Service Officer, Communications Department at 28th Floor, Emperor Group Centre, 288 Hennessy Road, Wanchai, Hong Kong, after which we shall cease to use and/or provide to other parties your personal data for direct marketing.

(9) Security of Data

9.1 We are committed to protect your personal data against unauthorized access, use, disclosure, processing, erasure or loss by taking all practicable measures.  However, despite our effort to protect your personal data, security cannot be absolutely guaranteed against all threats. To the best of our ability, access to your personal data is limited to our relevant employees and contractors who have a need to know and are required to maintain the confidentiality of your personal data. 

(10) Third-party links

10.1 Our Platforms may contain links to other websites, webpages, mobile applications or media platforms operated by other third parties (collectively the “Third Party Links”) which have their own privacy policies. We do not own and have no control over the content on these Third Party Links and shall not be deemed to endorse or recommend the content on these Third Party Links.  We shall not be responsible for the content of these Third Party Links and your use of these Third Party Links shall be at your own risk.  Before your visit these Third Party Links, you should read their privacy policy to understand the ways in which your personal data may be used by those third parties.

(11)  Your rights regarding your personal data

11.1 You have the right to ascertain whether we hold your personal data and access, update, correct and object to our use of your personal data held by us.

11.2 If you wish to exercise any of your rights above, please contact our Customer Service Officer by writing to Communications Department at 28th Floor, Emperor Group Centre, 288 Hennessy Road, Wanchai, Hong Kong. To enable us to handle your requests, we may ask you to provide your identity proof or any other necessary information for the verification of your identity.

11.3 To the extent permitted under applicable laws and regulations, we may charge a reasonable fee for the administrative costs incurred by us in processing and complying with your request above.  We may refuse to handle or comply with any unreasonable requests as permitted by the applicable laws.

11.4 We reserve our right to amend and supplement this Policy from time to time without notice. Please visit our Platforms for the updates to this Policy periodically. 

11.5 In case of any disputes concerning this Policy, our decision shall be final and conclusive.

11.6 If there is any inconsistency between the English and Chinese versions of this Policy, the English version shall prevail.
